By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1) Definitions

Content: All text, images, graphics, video, audio, software, designs, and other materials made available via the Services.
User Submissions: Reviews, comments, photos, videos, messages, or other content that you submit or make available through the Services.
Products: Any goods or services offered for sale via the Services.

2) License & Acceptable Use

We grant you a limited, non‑exclusive, revocable, non‑transferable license to access and use the Services for personal, non‑commercial purposes and (where applicable) for purchasing our Products, subject to these Terms and applicable law.

You agree not to (a) copy, modify, distribute, or create derivative works from the Services or Content; (b) reverse engineer or attempt to extract source code; (c) interfere with security, performance, or integrity of the Services; (d) scrape, crawl, or harvest data except by bona fide web indexing where not prohibited by robots.txt; (e) frame or mirror the Services; (f) use the Services to make unauthorized health claims about our Products; or (g) use the Services unlawfully or in a way that harms us or others. We may suspend or terminate access for violations.

3) Accounts

Some features require an account. You agree to (a) provide accurate, current, and complete information; (b) keep your credentials confidential; and (c) notify us promptly of unauthorized use. You are responsible for activities under your account.

4) No Professional Medical Advice

The Services do not provide medical advice, diagnosis, or treatment; all information is for informational purposes only. Always consult a qualified healthcare provider regarding any health questions or before using our Products. The statements on the Services have not been evaluated by the U.S. Food and Drug Administration. Our Products are not intended to diagnose, treat, cure, or prevent any disease.

5) Privacy

Your use of the Services is subject to our Privacy Policy, which is incorporated by reference.

6) Purchases, Pricing, Shipping & Returns

Eligibility: You must be at least 18 years old and authorized to use the selected payment method.
Pricing & Availability: Prices, promotions, and availability may change without notice. We may correct errors before or after accepting your order. If a pricing error occurs, we will contact you to cancel or reconfirm before fulfillment.
Taxes & Duties: Applicable taxes, duties, and fees are your responsibility unless we state otherwise at checkout.
Shipping: Risk of loss passes to you upon carrier delivery acceptance unless otherwise required by law.
Returns: Returns and refunds are governed by our Refund Policy.

7) Subscriptions & Auto‑Renew (if offered)

Some Products may be offered on a subscription basis (“Subscribe & Save” or similar). By enrolling, you authorize us (and our payment processor) to charge the then‑current subscription price plus applicable taxes and shipping to your selected payment method at each renewal interval until you cancel.

Auto‑Renew: Subscriptions renew automatically at the interval you select unless canceled.
Manage/Cancellation: You can manage or cancel before your next renewal via your account or by contacting support@balanceone.com. Cancellations take effect for future charges; processed orders follow the Refund Policy.
Price Changes: We may change subscription pricing with prior notice as required by law. Continued enrollment after notice constitutes acceptance.

8) Promotions, Coupons & Gift Cards

Promotions, coupon codes, and offers are subject to terms stated in the offer. Unless expressly permitted, coupons are single‑use, non‑transferable, and not valid on prior purchases. We may suspend or revoke offers for suspected abuse, misuse, or fraud.

9) User Submissions (Reviews, Comments, etc.)

By submitting User Submissions, you grant Balance One a worldwide, perpetual, irrevocable, royalty‑free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform and display your content in any media for any lawful purpose, including marketing. You represent you have all rights necessary to grant this license and that your content does not violate law or third‑party rights. We may monitor, edit, refuse, or remove content at our discretion.

10) Copyright Infringement / DMCA

If you believe Content on the Services infringes your copyright, send a notice compliant with 17 U.S.C. §512(c)(3) to:

11) Third‑Party Links & Tools

The Services may link to third‑party websites or integrate third‑party tools. We do not control and are not responsible for third‑party content, products, policies, or practices. Your use of third‑party sites is at your own risk.

12) International Orders; Export Controls

You are the importer of record and responsible for complying with destination‑country laws, paying any duties, taxes, or fees, and ensuring Products are permitted for import. We may decline or cancel orders affected by import restrictions. U.S. export control and sanctions laws may apply; you represent your transactions comply with applicable restrictions.

13) Disclaimers

THE SERVICES AND ALL CONTENT AND PRODUCTS AVAILABLE THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR‑FREE OPERATION OR THAT THE SERVICES ARE FREE OF HARMFUL COMPONENTS.

Some jurisdictions do not allow limitations on implied warranties, so the above may not apply to you.

14) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL BALANCE ONE OR ITS SUPPLIERS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICES OR PRODUCTS WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE PRODUCT(S) AT ISSUE IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

15) Indemnification

You agree to indemnify, defend, and hold harmless Balance One and its officers, directors, employees, agents, licensors, service providers, and affiliates from and against all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Services or Products, your violation of these Terms, or your infringement of any rights.

16) Governing Law; Venue

These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict‑of‑laws rules. You consent to the jurisdiction of the courts located in or serving Victoria, British Columbia, for any action relating to the Services or these Terms.

17) Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted on the Services with an updated Effective Date. Your continued use of the Services after changes become effective constitutes your acceptance.

18) Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you violated these Terms or for any reason. Sections intended to survive termination will continue in effect.
